1. Acceptance of terms

By accessing and using WP Dash ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of service

WP Dash is a WordPress management platform that provides:

• WordPress site monitoring and health checks
• Update management for core, plugins, and themes
• Vulnerability scanning and security monitoring
• One-click access to WordPress sites
• Performance and health reporting

3. User accounts

To use the Service, you must:

• Be at least 18 years old or have parental consent
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

4. Acceptable use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Transmit harmful, offensive, or inappropriate content
• Attempt to gain unauthorized access to our systems
• Interfere with the Service's operation
• Use the Service for illegal or harmful purposes

5. Account and referral integrity

To maintain the integrity of our referral system and prevent fraud:

• One Account Per Person: You may only create and maintain one account. Multiple accounts per individual are strictly prohibited and will result in immediate account termination.
• Real Referrals Only: Referrals must be genuine invitations to real people. Creating fake email addresses, using temporary/disposable emails, or self-referring is considered fraud.
• Referral Verification: We reserve the right to investigate and verify the legitimacy of all referrals. This may include email verification, IP address analysis, and other fraud detection measures.
• Fraud Consequences: If referral fraud is detected, we will:
• Immediately revoke all fraudulently earned website slots
• Reset the user's referral count to zero
• Suspend or terminate the account
• Report fraudulent activity to relevant authorities if necessary
• IP Monitoring: We track IP addresses for all signups and logins to detect suspicious patterns and prevent abuse.
• Right to Investigation: We reserve the right to investigate any suspicious activity and take appropriate action without prior notice.

6. Service limitations

WP Dash provides monitoring and management tools but does not:

• Guarantee 100% uptime or error-free operation
• Provide backup or restoration services
• Assume responsibility for your WordPress sites' content or functionality
• Guarantee the security of your sites (we monitor, not protect)
• Provide hosting or domain services

7. Pricing and payment

Our pricing structure is as follows:

• Free Tier: 3 WordPress sites at no cost
• Additional Slots: €20 one-time payment per slot
• No Recurring Fees: Slots are permanently unlocked
• Refunds: Available within 14 days of purchase for individuals

All prices are in Euros and exclude applicable taxes.

8. Intellectual property

WP Dash and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

9. Privacy and data

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Service, to understand our practices.

10. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms.

Immediate Termination: Your account will be terminated immediately without warning if we detect:

• Referral fraud or abuse of the referral system
• Creation of multiple accounts
• Use of fake or temporary email addresses
• Any attempt to circumvent our anti-fraud measures
• Violation of the account integrity rules

Upon termination for fraud or abuse, all fraudulently earned website slots will be revoked, and your referral count will be reset to zero.

11. Limitation of liability

In no event shall WP Dash, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

12. Disclaimer

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. WP Dash makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property.

13. Governing law

These Terms shall be interpreted and governed by the laws of Germany, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

14. Changes to terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect.
